These terms set out the agreement between you and Paused Beat when you use the website at pausedbeat.com and any related services. By creating an account, accepting an invitation, or publishing content on a memorial page, you agree to these terms.
Who we are
Paused Beat is a memorial service operated from Nairobi, Kenya. You can reach us at [email protected].
Who can use Paused Beat
You must be at least 18 years old to create an account or publish content. If you accept an invitation on behalf of a family, you confirm you have the family’s permission to do so.
Your account
You are responsible for the activity on your account and for keeping your sign-in details secure. Tell us promptly if you suspect any unauthorised use.
Memorials, roles, and invitations
Each memorial is created by a family member or representative (the “owner”). The owner can invite others as admins or contributors. Each role has different abilities to publish, moderate, and manage the memorial. The owner sets the memorial’s visibility (public, unlisted, or private) and may change it at any time.
Your content and the rights you grant
You keep the rights to the obituaries, tributes, photos, and other content you publish on Paused Beat. By posting content, you give Paused Beat a non-exclusive, worldwide, royalty-free licence to host, store, display, and distribute it for the sole purpose of operating the service in line with the memorial’s visibility setting.
You confirm that you have the right to post the content you share, and that doing so does not infringe anyone else’s rights or breach any duty of confidence (including in relation to photos and information about the deceased and other family members).
What you must not do
Paused Beat is a place of mourning and remembrance. You agree not to:
- impersonate another person or misrepresent your affiliation with a family;
- post content that is unlawful, defamatory, hateful, harassing, or sexually explicit;
- upload anyone else’s personal information without permission;
- use the service to spam, scrape, or send unsolicited messages;
- attempt to break, overload, or probe the security of the service.
We may remove content or suspend accounts that breach these terms, especially where a family asks us to act.
Reporting and moderation
If you see content that should not be on Paused Beat, write to [email protected] with the link and a short explanation. We aim to review reports from grieving families with urgency.
SMS and email
Paused Beat can send SMS and email notifications on your behalf to the people you invite. By providing a recipient’s phone number or email, you confirm you have a reasonable basis to contact them about the memorial. Standard carrier rates may apply to recipients. Recipients can ask us to stop messaging them at any time.
Fees
Paused Beat is free at launch, and the core memorial experience will always remain free. If we introduce paid features in the future (such as funeral services or contribution management), the pricing and terms will be made clear before you choose to use them.
Ending your use of the service
You can stop using Paused Beat at any time and ask us to delete your account by writing to [email protected]. We may suspend or end your access if you seriously or repeatedly breach these terms, or where we are required to do so by law.
Service availability and changes
We work to keep Paused Beat available, but we cannot guarantee it will be uninterrupted or error-free. We may change, add, or remove features over time. Where a change materially affects you, we will do our best to give reasonable notice.
Disclaimer and liability
The service is provided on an “as is” basis. To the extent permitted by law, Paused Beat is not liable for indirect or consequential loss, or for loss of data, profits, or goodwill. We do not exclude or limit any liability that cannot lawfully be excluded or limited under Kenyan law.
Governing law and disputes
These terms are governed by the laws of Kenya. Any dispute will be subject to the exclusive jurisdiction of the courts of Kenya, without prejudice to any mandatory consumer rights you may have where you live.
Changes to these terms
We may update these terms from time to time. When we do, we will change the “Last updated” date above and, for material changes, give clear notice on the site. If you keep using Paused Beat after a change, you agree to the updated terms.
